Terms of Use
These terms are an agreement between you and Off By 1 LLC (“we”), a Washington limited liability company, covering the Sentinel app and sentineldrops.com. We’ve tried to write them plainly.
Agreeing to these terms
By downloading, installing or using Sentinel, you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use Sentinel. You must be at least 18, or the age of majority where you live, to use Sentinel’s automatic checkout or buy a license.
Beta software
Sentinel is in public beta. It will have bugs, features may change or disappear, and updates arrive often. Don’t rely on it as your only way to know about something important to you.
Using Sentinel
We give you a personal, non-exclusive, non-transferable right to install and use Sentinel on computers you own or control, under these terms. We and our licensors keep all rights in Sentinel, including its code, design, name and logo. Updates may install automatically. These terms cover them too.
Stores and your accounts
Sentinel visits store websites on your behalf, from your computer and with your accounts. You’re responsible for how you use it with each store:
- Stores have their own terms, and some limit automated visits, automated purchases or how many items one customer can buy. It’s your responsibility to follow them. A store may block you, cancel orders or close your account, and we can’t prevent that.
- Keep your store logins, card details and computer secure. You’re responsible for activity on your accounts.
- Sentinel isn’t affiliated with, endorsed by or sponsored by any store it works with. Store names belong to their owners and are used only to say which sites Sentinel supports.
Automatic checkout
If you turn on automatic checkout, Sentinel can place real orders with your account and card, without asking you first. By turning it on, you agree that:
- You’re responsible for every order Sentinel places for you, including its price, taxes, shipping and quantity.
- You’ll set the price limits and quantities you’re comfortable with, and use test mode before placing real orders.
- Sentinel may fail to buy an item, buy it at a different price than expected, or place an order you didn’t intend, for example because a store changed its website. Returns, cancellations and refunds are between you and the store.
- We’re not a party to any purchase and aren’t responsible for the store, the seller, or the goods.
Alerts
Sentinel tries to notice restocks quickly and tell you right away, but we don’t guarantee it will notice every restock, notice it in time, or deliver every alert. Stores, networks, Discord and your computer all affect whether an alert arrives. Sentinel only works while it’s running and your computer is awake and online.
Things you agree not to do
- Use Sentinel to break the law, or to commit fraud, including with payment details that aren’t yours.
- Use Sentinel to attack, overload or disrupt any website or service.
- Get around Sentinel’s license checks or paid-feature limits, or share license keys beyond what your license allows.
- Resell, rent or redistribute Sentinel, or remove its notices.
- Use our servers, plugin store or Discord relay in ways that harm them or other users.
Paid features
Some features may require a paid license. If you buy one, the price, billing period and refund terms shown at checkout apply, and payment is processed by Stripe. Subscriptions renew until you cancel. A license covers the number of devices stated when you buy it.
Other services
Sentinel works with services we don’t control, such as stores, Discord, proxy providers and the alert services you choose. Their terms govern your use of them, and we’re not responsible for them. Store plugins we publish are part of Sentinel under these terms. If you load a plugin from somewhere else, you do so at your own risk.
No warranty
SENTINEL IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT IT WILL BE UNINTERRUPTED, ACCURATE OR ERROR-FREE. Some places don’t allow these exclusions, so some may not apply to you.
Limits on our liability
TO THE FULLEST EXTENT THE LAW ALLOWS, OFF BY 1 WON’T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, MISSED PURCHASES, UNWANTED PURCHASES, ACCOUNT RESTRICTIONS OR LOST DATA, ARISING FROM YOUR USE OF SENTINEL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50.
You agree to cover our reasonable costs, including legal fees, if a claim is brought against us because of your use of Sentinel in breach of these terms or a store’s terms.
Ending these terms
You can stop using Sentinel at any time by uninstalling it. We may suspend or end your access, including license checks and plugin downloads, if you break these terms, or stop offering Sentinel with reasonable notice. Sections that by their nature should continue, such as automatic checkout responsibility, no warranty, limits on liability, and law and disputes, continue after these terms end.
Law and disputes
Washington state law governs these terms, without regard to conflict-of-law rules. Any dispute will be decided in the state or federal courts located in Washington, and you and we agree to their jurisdiction. Before filing a claim, please contact us through offby1.tech so we can try to resolve it informally.
Everything else
If we change these terms, we’ll update the date above. For significant changes we’ll also say so in the app’s update notes. Continuing to use Sentinel after a change means you accept it. If part of these terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver. These terms and our Privacy Policy are the whole agreement between us about Sentinel.
